If a landlord does not get the CofC:1) The Building Safety Engineering & Environmental Dept (BSEED) inspectors may issue the following tickets:- No property registration- No city inspection- No lead-based paint inspection- Renting without a CofC2) A landlord can then attend a Department of Appeals & Hearings (DAH) to challenge the tickets, but unless you have an active eviction, your chances are slim.3) Technically, if you start an eviction against a tenant, the court may throw out your case if you do not have a CofC. 4) At any time, a tenant can deposit their rent with the 36th District Court and the landlord will have 90 days to get the CofC.

If you do get audited and the tax court disagrees, the penalties could be significant, which you would then come sue me for.Tough call, but I feel like I would want a determination letter from the IRS before filing to be sure.This article seems to infer that most determination letters related to this circumstance have been approved and you would want to make your case under the "environmental" category. http://www.journalofaccountancy.com/issues/2009/no...

Hello, I have a great interest in environmental sustainability and have read a few books on green real estate development such as "Green Home Improvement," "A Contractor's Guide to LEED Certified Construction," "Green Building and Remodeling for Dummies," and others.I like the idea of starting out small with my rentals where it makes sense - energy efficient appliances, using recycled materials when doing upgrades, with the possibility of branching into adding solar panels/doing green new build construction once I gain experience and know areas where it will be profitable.
