They just don't get to claim the deferment for that tax year but they do get the benefit of the 10 year mark for the 1400z-2(c) Special Rules for investments held for at least 10 years.

The reason that the opinions are 50/50 is because statistics show that about 50% of investors are using a LLC, 50% not.To me this would indicate that it is not necessary otherwise by now the number using a LLC would be approaching the 100% mark.

Either way, in order to get REFI and potentially take cash out now, before most bank's 6 or 12 month marks,  you'll need either a tenant in place or at least a letter of intent from a future tenant with a lease agreement and start date.
