I think you need to contact an attorney on the island who specializes in inheritance / herencia laws. 

Same thing if there was a short fall and a special assessment was done, would you owe the new owner money since the deficit happened while you owned it?

Insurance will cover damage to their possessions, but you are talking about inability to use the apartment, not their possessions.Lack of water/sewer service means the apartment is uninhabitable.
