In addition to the criteria you listed above, I check census data for net migration, educational attainment, median income, etc.

It seems to me that in this scenario, if the rent is raised, it could be concluded that due to lack of any other infractions - the rent raise was caused by attainment of ESA.

In other words, the hurdle to clear in attaining the asset protections of an LLC are very high.
