For example, you can have a binding real estate contract that stipulates penalties for late delivery or construction defects. 

Title insurance protects the buyer from potential undisclosed liens or defects in the title of the property that aren't discovered during the title search before the closing of the sale.

However, if you need a whole new roof because it is generally so old that it is failing all over that's a different story, but then, age is not a defect.

Somebody wanting to sue for you backing out of a bad deal or accusing you of selling them a property with defects like unknown termite damage).

How successful you'll be depends in part on the condition of the property today, what material defects exist, and remediation and improvement will do to the value. 

This is not to say you should be covering material defects such as mold.. 

But, since my priority in July is talking to the owners, and using my notices (as defective as they might be) as leverage in the discussions, I will do the alternative service even though it's not required by the statute.

Were all the defects got repaired or only the major ones?
