I have a tenant with a malfunctioning water heater that spews water everywhere running up the water bill that I pay.

Tenant isresponsible for reporting malfunction or unsafe appliances. 

@Zachary Inman Yes the property insurance did wind up covering it under an "equipment failure/malfunction" clause.

They could and probably would deny claims over this.As other have mentioned, things like gaskets and valves are designed to be used and not using them can cause them to crack or malfunction.

Hey All, My wife and I are planning to rent out our current condo in the next few months and I am in need of a solid handyman in the area that I can call on if anything breaks or malfunctions while we are away.

EXAMPLE: appliances - our lease states they are not warranted by owner and if they malfunction or stop working it's up to tenant to address.
