The fact pattern is the same if instead of "you", the recipient is "your single-member LLC" unless you elected to have the single-member LLC taxed as a corporation.

clearly a person to person is needed with these people no matter what you do. the pattern has already been set that they will do as they choose until... and absolutely do NOT cash the check. it will so haunt you if you need to take other measures later. it expresses the opposite of what you are attempting to do in the eyes of the law. this has been my understanding in california as well as virginia. i'm by no means a lawyer though, so cannot explain the nuances. seems perhaps time to look for another tenant though. just my opin.

I will note, briefly, that there could be additional, unknown facts that could potentially lead to legal problems down the line, but there is nothing in your fact pattern that necessarily addresses those concerns.

@Linda Malavet Oh yeah cash flow is nearly non-existent in LA, I mean, I'm sure it's out there somewhere/somehow but all the buy and holders I know are in a major holding pattern, they're refi-ing everything they've got to take advantage of the still cheap money and just building war chests, praying that the market takes a hit sometime in the next few years so they can move back-in and start buying again.
