In many areas though if you do not allow the EMD to be returned, it can be pretty easy for this "buyer" to cloud the title to prevent it from selling to the next buyer.

some sellers, if they are crooked will try to go around you and sell to another buyer even though you have a contract with sellerIf think that might be the case then take your contract and go record it at the courthouse so the seller can't go around youIt will cloud the title and they won't be able to close without paying you off
