I see this parking spot as a common element-part of the property but deeded to no particular unit, so not a limited common element. 

The seller has had a buyer approach him numerous times attempting to buy everything but he continues to decline all offers.

It sounds like you recognized the red flags fairly early on, yet you decided to proceed with things until the red flags become too numerous.
