I have been informed that criminal charges and court ordered restitution are not removed in bankruptcy and that people have been incarcerated for these types of offenses.

If something were to happen not only will you feel terrible (I assume, because your picture makes you look like a good guy), you will possibly be violating local laws, almost certainly not be covered by your insurance and stand a good chance of being sued if not incarcerated

I also have a handy clause in my lease that requires my Tenant to name an individual to take care of their personal property in case of incarceration, incapacitation, or death: EMERGENCY CONTACT.

She's was also agreeable to have another tenant sign/move in as she is unsure how long she will be incarcerated (both conversations were had on a recorded line).My initial assumption is I should be okay to list and sign a new tenant anytime after the old lease expires.Has anybody been through a similar experience with a tenant "vacating" the property due to arrest and/or the tenant giving permission to remove belongings and get the unit rented to a new tenant?

If he has had multiple DUI's, it's just a matter of time until he will be incarcerated again and since his previous stays were so long (30-90 days) I would say, deny him.His next stay could be an entire year.

There are also various local government programs for the recently incarcerated (I've done loans for felons), people that just finished rehab (check), domestic abuse victims (check), and so on.A caveat for #2.
