This is what I am encountering, in the current Mortgage Industry.If you think you will go FHA, Conventional, FHA 203k, etc. and then Quit Claim the property, to a Corporate Entity, or a Land Trust you run the risk of the lender discovering a Title Transfer occurred and activating the "Acceleration Clause" or "Due on Sale Clause" that requires the loan to be paid in full, within 'x' number of days.

I suspect that DSCR lenders are more likely to exercise the DOS option when transferred.

The way we process distributions is once they submit a request, they must fill out a redemption form from our transfer agent (who holds the shares/ manages cap table).

You may need to seek legal counsel on this.2) Get all the info about your rental property as possible: leases, rent ledgers, tenant contact info, etc.3) Start looking for a new PMC4) Execute your termination notice5) Once transfer is complete, circle back to decide if worth suing them.

@Jonathan Greene @Jay Hinrichs @Nicholas L. short sales are almost always done through RE agents and are a major pain the butt if the lender servicer wont respond in a timely fashion.Pre foreclosure you dont use and agent but if your talking NY I think and not totally sure but I think only an attorney can draft the Deed transfering title .

Could you gift the down payment to your mother in law so she can buy it and then transfer title to you when your house is done?

This is another reason why I see 1M posts on hear about people wanting to transfer properties to their LLC because some guru they paid $5k told them too.

I would still work with a title company on this and let your lender know (if you have one) of the name change and what you are doing so they do not think you are selling the property.Another option would be to create a living trust for estate purposes and transfer it into the estate.

But they are working hard to try and make the permits non-transferable.
