TN is a "hybrid" state -- if you win the auction, you get a first lien on the property, and if it's not redeemed withing a year (all the past due taxes are paid in full) you automatically get a deed to the property.

In other word, if seller doesn't want to pay buyer agent and the offer is coming using FHA/VA loan, it would be automatically rejected by seller.What a mess....

In Brandon Turner's book "The Book on Managing Rental Properties" he talks about accepting the initial deposit as a deposit to hold the unit and has verbiage that the "deposit to hold" will automatically convert to the security deposit upon move-in.I'm working my way through the book now, so it's fresh in my head.
