Maybe a first time offense would be to write a letter stating what caused the problem and that future re-occurrences will likely be acknowledged damage to the property leading a breach in the lease.

They sometimes take offense to that term when they still care about the house, are in fact still paying taxes (you don't yet know if they are or aren't) and checking on the property from time to time.Check with your local county recorder and see if the house is in foreclosure.
