When you see a house within a trust you'll have to make sure that the person selling the house has the trust certificate, and there is a form that will need to be filled out and notarized by the person named on the trust.

Here's the simple solution:  Buy an option for $10 for the price of the house at his value plus your investment plus half of the profit expected, sign and notarize and file a memorandum of option with the county.

Biggest problem I've seen is with notary issues, sale contracts don't need to be notarized financing type installment agreements do.

The notary then has the seller sign the deed, notarizes it, gives the seller funds and then sends my office back the deed for proper recordation.That's really it.

The underwriter on the deal had me send in a Notarize letter giving her permission to use the money in our joint account .The reason for the letter was because we were not married at the time,  She was using the money in that account for the 3.5% down payment and for closing cost.

you would file the claim because its your property, they would just be there to back you up. unless you give them the legal right to represent you, you would have to write that up and have it notarized that they are acting on your behalf.
