Additionally, there could be issues when it comes to marital status for example if one of the 5 people get a divorce down the road and then the ex wants a piece of the action.It may be best to buy the remaining siblings out so there are fewer claims to the property.

@Ashley Wynn I purchase with HML in a single member LLC under my name only (or my husband if it will be his property)> refi to my personal name (or my husband's) > and then warranty deed (not quitclaim... very specifically warranty deed) to my single-member entity (or entities roll to our trust...so then we both have marital rights).

At least in Florida, using the deposits to build requres an additonal contract and lawyer or there could be signifiant risk.We are opportimnistic in building.

If it isn't in the operating agreement, it probably defaults to state law, so you need to look in the corporations law sections of LLCs and see how your state treats vacancies, it may simply revert to a single member if she resigns.Just guessing, I'd say an attorney would suggest a wife being in the company for estate issues and taxes based on your ownership, then as to marital property issues (divorce comes to mind) and that any "life events" would better be served in that manner.
