The governmental agencies will argue this means the licensee - wholesaler - contract flipper will need to get a signed statement from the homeowner stating that the homeowner is aware his home is worth more than the licensee - wholesaler - contract flipper is paying; that he is aware that the wholesaler will not close and the deal will only close if he finds a buyer at a greater price and THAT buyer closes, and that the licensee - wholesaler - contract flipper doesn’t have a particular buyer ready to buy and is going to market the property without the benefit of having it on MLS.

Tell the current PMC to transfer the SD to the new PMC, that way they have a record of handing it off to a licensee (assuming PMCs are required to be licensed in your state) and are covered in case of a Real Estate Commission inquiry.
