Example, in my state the security deposit must be held in seperate account or you could forfeit the entire deposit regardless what the tenants do to your property.

My daughter had a similar situation, and she told them she planned on suing, but if they would agree to forfeit the termination fees, she would settle for that.

If they pass it over, they forfeit it; if they end up moving in, apply it to the security deposit or rent.
