Check your local laws, but in at least two jurisdictions I know of, the action for possession (Unlawful Detainer) can be granted due to the past due rent or other charges, and ultimately specifies the total amount owed including legal fees.

My attorney suggests getting the unlawful detainer paperwork going now instead.Has anyone heard of this new law on Cash for Keys for at even at- fault (non-payment of rent) termination? 

Now if you're a glutton for punishment, don't mind cold calling and/or door knocking, have the gift of gab and/or are exceptionally outgoing, and have a war chest of money to spend on marketing and your own living expenses while not getting paid for months on end...then by all means become a real estate agent. 

Turns out it was still unlawful, and I got it removed. $20k later in attorney fees after a pain the *** battle. 

But it is an inevitable consequence of a system that rewards certain behaviors and punishes the poor.

This is a crucial step that I missed and as you can tell by my first statement, its punishing me!
