My brother's rental is a little over 1,000s sqft heated living area, so the ADU would only be permitted for 500 sqft in Winston-Salem, according to information I found online .One advantage of an ADU I believe would be the ability to hook up to the primary residence's utilities.

Another thing to consider is if the property and loan are in the LLC, not sure if it is currently against your credit and if you had to guarantee the loan but if you move it to your name now you have to include it in your DTI, so that could impact your borrowing ability

I say “currently” because there is a bill passing through the legislature even as we speak to remove that requirement for 3-4 unit properties, so patience might be rewarded.And just make sure the zoning allows 3-families before you make a decision based on that potential.

I've never met a long term real estate investor who wished they had bought less property.If you invest $100,000 in T-bills this year at 5% in a year your return is 5000.If you invest $20,000 to buy $100,000 of real estate and it goes up 5% your return on the $20,000 is 25%, not including the rent, the depreciation, the tax advantage, the ability to defer taxes, and your tenant paid down $1000-$1500 of your mortgage....these are the bare basics.

Typically, in this situation, I advise my property management clients (in Florida) to terminate the month-to-month tenancy of a tenant who is causing problems like this and to place a better tenant in the unit.As for the tenant who is requesting to get out of their lease, of course, you do not have to release them from a lease term on that basis, but look to your lease and state laws regarding their ability to terminate the lease (whether a lease term or month-to-month).
