The barrier is the additional complexity - now you are operating two sets of books, and filing two tax returns, and have more operating agreements, more state registrations, etc, need to manage cash better, need to keep in constant mind that your rents need to be a supportable FMV, which may require getting third party certification on your rents so that in the event of an IRS audit, what you have done is supported.In short...the size of the project, and the taxable income, need to be of enough scope to make all the additional costs and annoyances worth it.

In general, partnership entities do not pay taxes.They pass-through income which is reported on the form K-1 where the member / owner / investor will pay tax when they file their individual return.Furthermore, aslong as all members / owners / investors agree that no one is entitled to a salary, that is okay, aslong as everyone agrees to it.

I quit in 07 when the laws were enacted.. you absolutely do not want to run afoul of these.Property Radar app is awesome you can use it out in the filed it will show in real time right on your phone which homes are owner occ or not.. its the most sophisticated Awesome thing I have ever seen in all my years In real estate I can't see how anyone on the West coast would not have this is they were serious about this industry...
