If the management company didn't get the itemized damage invoice to the tenant within 45 days then yea that's a problem as each state has a set period of time that this must happen or the tenant could sue for return of the deposit and in some states can sue for double damages.

The big problem as a Realtor is when you show your Seller all the great stuff you have put together (CMA, Comps etc.) and you have the proforma as part of the information they will automagically want to price the property at proforma, not based on current NOI.Now you are going to have a hell of a time getting his price back in line...Good luck!

Either way, I don't see the logic in the argument that your vacancies are a function of the properties being out of state.Would a landlord in Maine who owns out of state properties in San Diego have the same problem as you getting them rented as quickly as they are able to get their maine properties rented?
