I have not had the tenant sign a new lease yet because I want to see if I should write it in the LLCs name or mine.

For example, if there is some dispute about whether someone has an interest in a property, they can sign over their rights without ever establishing what those rights are if any at all to clear up the issue.

Read the lease , if thats what it says and you and your daughter signed it , then they can take you to court and will probably win

Well I just spoke to the bank serving the assumable loan and they said they could sign me a waver that the due on sale clause will not trigger as long as you paid.

I could have him sign a buyers agency agreement that can only be done for three months and he can technically cancel anytime.
