@Cj McDougalRead California Civil code 1954 which regulates landlord entry.Unless you read it and have a different interpretation than me In California: The only legal way for a landlord to enter a property without consent is for an emergency or if the tenant has abandoned the property.

Yes you can take out an insurance policy on someone with equitable interest but you would need their consent and I’m not sure “collect big” will work since your equitable interest is probably only a few thousand dollars.

Even if you haven't or don't plan to form an LLC, it's not a bad idea to notarize your contract/operating agreement to spell out "if this happens, we do this" for every conceivable potentiality regarding the property and each other - particularly with regards to if one of you wants to sell and the other doesn't, or if one of you ceases, even temporarily, being able to meet your obligations to the property for any reason at all.Just a few of the things off the top of my head from one of my contracts:Noting which parties contributed how much towards capital.Establishing right of first refusal in the event of one party wishing to sell.Where bank accounts, credit cards etc are held, and who can do what with them.Cash flow protocol (all rental income goes into X account, $Y each money gets autotransferred to savings, $Z each month is put towards maintenance, etc).Disbursements of surplus money in X account can only be made if certain conditions are met.Explicit recognition that all bills may only have one party's name but are a shared responsibility between or across partners.What items require unanimous consent to proceed from partners?

I would just state clearly that additional occupants cannot be added to the property without prior written consent and screening by the landlord.

You are also running into privacy issues if you do decide to get this info without the consent of the individual.

Matt:If there is a JV agreement, then when your "partner" is asked if there is a 3rd-party interest in the property, he would be beholden to disclose that to the lender.In practice, this happens where the JV agreement is just a handshake, but you as the non-partner, partner are taking on a huge risk as you have little to no provable claim on the property ... and if you did prove your interest, you could be a part to mortgage fraud :-(In the U.S.A. it appears there are (or there were) lenders who would allow a single member of an LLC or partnership to taken on the burden of the financing ... though I presume all members would have to consent to the pledging of property as the mortgage.In Canada, lenders require anyone with an interest in the property to a guarantor of the financing (with exception of minors ... but their trustee would have to be a guarantor).

I have a pet clause in my lease that says "No pets, birds, or animals of any kind allowed on premises without written consent of landlord and Pet Addendum signed".When my tenants moved in, I asked them if they had pets, they said "no".

But you are also not required to give the forms back as they consented to you looking up their credit and personal information on the app form and it is now considered administrative records for your business.

If they have a good relationship, maybe she can help facilitate you viewing the property if he is okay with that.But keep in mind that even if he does consent to you accessing/viewing his house, that does not give you the right to bring "a police drug dog to go through the house" with you.
