But contrast to the same scenario let's say criminal records occur within a year or so that's risky for me because there is no space to know if it is a downward spiral vs lesson learned.

Without reasonable late fees, which what you're proposing is, I think it's a recipe for some inevitable late paying tenants to pay months late, not take it as seriously, and have it spiral out.
