I would suggest you get legal Advice, $500 in legal Fees beats having a vendor's Lien and Lis Pending filed against you property.A vendor's lien is a purchase money security interest given voluntarily.

Based on state codes landlord can ask and tenant can voluntarily agree however when a tenant does not agree to any requirement a landlord has no legal authority to require tenants to comply.

The biggest risks with taking the loan against the 401k is that if you leave your job (voluntarily or otherwise), you typically have 90 days to pay off that loan or it will be treated as a withdrawal and subject to the 10% penalty and taxed accordingly.
