If an unlicensed wholesaler can operate without using any oral or printed solicitation to sell real property of others or interests therein, or who takes any part in the procuring of purchasers, or receives, expects, or is promised any compensation or valuable consideration, directly or indirectly therefor, then you're right... but that's a pretty high bar.

There might be homeowners that bought there but ended up not liking the area, or job moved them elsewhere, or plans changed and they were waiting to try and sell until they weren't in direct competition with the developer anymore.
