There could be a possibility of buying the note without consent of the owner, but you would simply be taking the place of the bank and would need to foreclose if the owner would not provide a deed.Any pre-foreclosure ploy will require you working with the owner.If you are planning on going to the sale, run title to check for liens and get your money together ready to bid.

The language in my lease states that after the expiration of the year lease, it then goes to a month-to-month tenancy with the consent of the Landlord.

If they are on a month to month, you may want to first consider keeping it that way - you don't know what kind of tenants they are until after you move in and it is possible to make changes that do not require a tenant's consent with a rental agreement.

I have it stated in the lease agreement no repairs or alterations which include painting, wallpapering etc to the premises are allowed without written consent from landlord.

The first line of my addendum reads: "This Addendum incorporates by reference the P&S Agreement between the Seller and Buyer dated ___, and should any inconsistency exist between this addendum and the P&S Agreement, this addendum shall control."  2 Critical Terms to My Addendum:1) In California, the standard P&S Agreements / Offers Forms contains language that an assignment can only be made if you get the express written consent of the seller.

If you do without their authorization, it can be a violation that can be considered a default or allow them to call all payments due, all depending on the wording of the security instrument.If you pull up a standard Fannie uniform instrument and look at clause 18 (or close to that number) you will see transferring any interest in the property without lender's prior consent will accelerate the loan to have payments due to get an idea where to find it (if you are getting a fannie loan) or what some of the identifying language may look like.
