This tenant declared bankruptcy which stayed the first writ of possession that I got.

Just coming back to update all those that offered advice on this original post....I did go down the eviction path, won the eviction hearing and, as of today, have regained possession of the property, to include having a locksmith rekey the locks.

I'm not an attorney and not giving legal advice.So clearly this is an amateur landlord because no professional in their right mind would allow documents to be tendered after you've taken possession.

The landlord then said to me as long as someone is in "possession" of the unit, I would still be liable.I ask if this person does not qualify for their own lease, what coarse of action to I have to get my name off the lease.
