You may have to pay off the whole mortgage if the due on sale clause is exercised.No need to move in an LLC if it has a big mortgage and insurance.An LLC can also give you a false sense of security that can easily be pierced with a decent attorney.Just have correct insurance and properly maintain your property.

In PA this does not go to an overage fund or surplus proceeds fund.. instead.. in an upset sale any amount bid over the minimum starting bid in the Upset Sale will be applied to liens against the property in order of position… since the min bid includes all municipal, back taxes and county liens.. then would it be correct to stated that this extra 10k would go toward the remaining Morgage amount (if applicable) IRS liens, cigarette and sales tax liens etc..?

Spoke with an Attorney who advised that I was correct in the situation and mentioned posting notice on the Tenants door, as well as Certified Mail, then going to the Magistrates office to file and Landlord / Tenant Complaint.
