Old Texas Landlord law?
22 October 2021 | 26 replies
Meaning a tenant can SHOOT YOU DEAD if you attempt to steal their property and never be prosecuted (well, maybe prosecuted but unlikely to be convicted).Any landlord or property manager who tries to take a tenant's personal property for payment of rent or hold hostage a) is a bloody fool, b) too stupid to own/manage rental property, c) will likely be the reason the Texas legislature cracks down on that stupid law.Don't be that guy.

It’s also mortgage fraud, which can be criminally prosecuted. the reason is that the lender inherently incurs more risk when it is deemed an investment property ,therefore they command a higher investment rate.

Or why not pass a criminal defense law that says the prosecution cannot spend more money than the defense (equal funding to both sides) - so that less people are compelled against their will to take a plea deal that includes a conviction just because they're scared to get a worse outcome if they go to trial with a public defender with 1/10th the budget to put on a defense.

You will need to play very "by-the-book" to make sure that you don't accrue code violations and fines in your personal name as they will be substantially easier to prosecute against your individual person vs a corporate structure.

Tenants got my property condemned - do I evict?
25 March 2020 | 26 replies
Starting an eviction after the tenant called the city who then condemned your property would, IMHO, be just as big a mistake as waiting six months to get the gas issue repaired.Retaliatory eviction is a no-no, and no MDJ or higher court will be friendly to this kind of easy-to-connect-the-dots prosecution against you.The property is uninhabitable; get the plumber to get off their *** and get the job done.

My thought is that as long as you are being honest, if it turns out the program won't pay landlords with no employees or whether you shouldn't have submitted 2 applications or whatever, it is likely they won't prosecute you for anything.
