If not are there other approaches to finding out without straight up asking the seller?

I would always have the note(s) notarized.

I would like to keep the property in the Living Trust and have my sibling sign a deed transfer then have it notarized the same day with my sibling present, then I will pay him his Equal share of what the total value of the property is. 

They probably won't file the quitclaim for you but they can prep it for you to get notarized and then you can mail it in yourself.

; are they getting their deposit back and if not, why not; are they presently working or have a steady income, enough to cover rent? 

If not are there other ways we could structure the deal to limit his tax liability, he does not plan on buying more property so an exchange is not an option. 

We plan on finalizing our LLC this week and then would be looking to get the Operating Agreement notarized shortly after.

All I offered them  $200 for their time to sign QCD and got it notarized at a bank.

Had to get a Deed in Lieu of Foreclosure signed and notarized by the occupant so they wouldn't tear up the property before listing.

I served a five day pay or quit (which I had notarized), I waited until the 6th day and began eviction proceedings at the county courthouse, and filed for "forcible entry and detainer."
