In the state of Ohio if the property is in an LLC you MUST hire an attorney to represent you.Once you file the paperwork, the municipal court will schedule a date as well as send out mail, certified mail and typically send a baliff to make contact with the tenant.

If I were representing you, I'd strongly advise you against it.At this point, read over the contract closely and see if there is a way out.Failing that, talk with the builder and see if you can work something out.If that doesn't work, try talking with an attorney to see what can be done.If there's no positive result there either, you may be stuck with it for the remainder of the first year.

In my experience it should not be your responsibility to pay the lien, it will get paid off prior to or at close.With that said, I have represented buyers and have personally purchased properties off of all the auction sites here in CT and in a lot of the cases the title did not come back clean initially.
