The only way around the situation (from what I can see) is to have delivered the proper notice to the tenants and waited the time for them to decide -- if they were agreeing to move out, most likely they would not have jumped through the hoops to purchase and you would postpone closing approx. 2 months.

June 2010 had 586 properties listed (most of which were postponed for whatever reason); of those, 103 sold to the foreclosing lender and 6 sold to parties other than the foreclosing lender - I know at least one subordinate lienholder was among that 6.

Those years are hopefully good cash-flow years for you and those pesky cap-ex expenditures can be postponed until your income needs drop.
