1) I don’t know why you wouldn’t when included stipulations when hiring the PM BEFORE they started advertising and found a tenant.

As everyone has said, you'll need to live in the property, but as long as you do that, there aren't really any other big stipulations.

@Scott BridgehouseUnless the lender stipulates differently in their documents (like VA financing that requires owner occupany for the duration of the mortgage), 'owner occupancy' requires that you move in within 60 days and retain it as your primary residence for 12 months. 

You could tell them that they would need to sign a new contract stipulating if they miss rent payments "X" amount of times it effectively terminates the contract.

Should I get the police report and send a letter to the upstairs tenant reconfirming with them the stipulation in our lease of quiet enjoyment?

The lease that I use stipulates that if I send someone and it's a non-issue then I can collect the charge from the client.

Let them go.... with the stipulation that you can start advertising and showing the unit ASAP- they make sure the unit is in good condition and kept clean during the process.When people need/want to leave, they will..... the lease wont stop them.

There's a big difference in the order of payout in the event of a claim.If the buyer defaults on the payments or any other stipulations of the note, you will need to hire an attorney to foreclose and get the property back.
