@Scott BridgehouseUnless the lender stipulates differently in their documents (like VA financing that requires owner occupany for the duration of the mortgage), 'owner occupancy' requires that you move in within 60 days and retain it as your primary residence for 12 months.

You could tell them that they would need to sign a new contract stipulating if they miss rent payments "X" amount of times it effectively terminates the contract.

Let them go.... with the stipulation that you can start advertising and showing the unit ASAP- they make sure the unit is in good condition and kept clean during the process.When people need/want to leave, they will..... the lease wont stop them.
