Texas is the last place I would personally buy a rental if I did not live in Texas for all the reasons you mention add in soil problems and hail storms etc..

I'm working on roof and siding repairs from hail back in May.  

Two of my rental properties received hail and wind damage during the summer.

But at 3-4X the costs of a regular roof, and no guarantee that they will survive the next hail storm (the five year old impact resistant roof I replaced did not) I can't do it.

I already knew the answer but I was hoping someone else knew something different that I didn't and could offer up a hail Mary.  

A Hail Marry option could be to go along with what the Seller's Attorney wants to get an opportunity to settle without litigation. 

In every case that I can remember it was someone who was 2nd or 3rd in line, each of them adding some greedy Hail Mary assignment fee.
