He says that the kids probably won't be there that often, so I am thinking that she does not have sole/full custody of the children. 

Since there is no custodial requirement for the 401k, you don't need the additional expense and administration of an LLC to obtain checkbook control.

@Paul RileyI would recommend comparing custodial fee schedules and reviews regarding processing times and customer service for various companies.

Custodial accounts do not  come with "checkbook control".
