If you sign a PA and have NO ability to perform on that contract (wholesaler without any ability to purchase), and the Seller suffers damage (unlikely but not impossible), Buyer wholesaler may be held financially liable for Seller damages.

She called me back a week later.Seller received another offer of 36k from another person's direct mailer but she told me flat-out she did not like the guy and prefers to sell to me.I have a meeting scheduled with her next Tuesday to sign a PA but the only issue is price!

So assuming I like the property (I have a showing tomorrow afternoon), should I ask her to write up a PA and give her 2K personal check for earnest money?
