If the tenant doesn't show up again, you can ask for an "execution" (no, it's not capital punishment!)

My partner and I work in commercial real estate development, but would like to branch out and execute our first fix and flip project.

I am looking to get into commercial multi-family and I have been asked for an executive summary.

There isn't *no* case law, just less than the Traditional LLC--simply because Traditional LLCs exist in all 50 states and there are established vulnerabilities to these entities.

I had read that some custodians have restrictions on certain investment types so consent is required before execution of an investment could take place. 

A realtor's job is to advise and execute the client's (your) plan even if the chance for success is ~0%. 

Because the demand for it will be low.Likewise you can have an older building that needs work, but in a GREAT neighborhood where everything has been rehabbed, and the area residents are all executive level professionals, and it can make your property a class B or A property.

Question is: should we execute cash-out refi AHEAD of renter signing lease or AFTER?

I’m sure there are exceptions but as the saying goes those who can, do(execute) and those who can’t, teach.

You need to convince the seller or his agent that you have the financial capacity to execute the transaction.
