The option price usually applies to the sale price, so at that point, you have collected payments to reduce a sale price that constitutes financing, which then can get you in trouble.Usually, the option price is credited to the sale price, but guess what.....it doesn't have to be, the option price is for the right to purchase over the term at a stated price. :)

LOL, I suggest you read, slowly, the RESPA regulations, which are law, become very familiar with your state regs on what defines and real estate agency, agency relationships, paying for real estate brokerage services and make sure you don't do any of those things.There are states, Maryland comes to mind, that has a lose definition of what constitutes a real estate agents' duties.

Hi Kristine, thanks for your quick response....the MH is in a park....The Promissory Note and Security Agreement is a doc between the buyer and myself and not recorded...simply stating the term of what constitutes default and agreeing that if and when agreed upon amount is paid in full I will sign over title and registered owner status over to him.
