So, yeah, it's a smart approach and if the numbers are favorable and you have Plan B in place you can do this successfully.You would need to record a notarized memorandum of the option with the county to protect your position in the deal.

I'd make sure the sales agreement is clear, notarized, go through a title company, etc., but I could see a judge either feel like I'm trying to get one over on him, or just not understand the idea of a non traditional sale.

you cant record sales agreements etc in most markets i work unless they are notarized by the seller..
