But, if you have clear evidence that fraud was committed, you may have legal action against GP, but this is typically hard to prove, and likely going to be costly for you to pursue, and if the deal is already failing, there likely isn't much of anything left to collect anyways.

If Borrower fails to pay these sums prior to, or upon, the expiration of this period, Lender may invoke any remedies permitted by this Security Instrument without further notice or demand on Borrower and will be entitled to collect all expenses incurred in pursuing such remedies, including, but not limited to: (a) reasonable attorneys’ fees and costs; (b) property inspection and valuation fees; and (c) other fees incurred to protect Lender’s Interest in the Property and/or rights under this Security Instrument

What if they have collections or judgments?

If she is transitioning to a house, she'll need to either do the month to month route or take the leap of faith that she'll find something when she needs to since houses don't typically come up for rent until they're vacant and ready to be leased.
