That assumes beachfront -- oceanfront, of course, doesn't have that concern (but may have others).

I put that project on the back burner since higher development costs and thin margins were already causing us concern. 

Maybe I am miss understanding your concern... a Non-Disparagement Clause normally means that you will not publicly speak bad about each other.

I'm only concerned with the financial logistics to get the mortgage in my name rather than theirs.

The broker I'm working with, mentioned that any company can cancel any policy within 30 days of approval and that any premiums paid will be refunded, but my main concern is to get a policy in place for this property.

If they are overpaying and you are concerned with turnover, then I would help them out with the landscaping.

I suspect the new title examiner has found something in the chain of title or the execution and notarization of your deed that makes them unwilling to rely on it to issue your buyer a policy without exception for the concern(s).
