It takes a long time to find an off market deal.

The agent just let me know that they cannot offer these rates for investment properties.

The bigger issues that need to be addressed by the operating agreement are how you deal with disagreements. 

If he had quoted you 20% higher would you still have done the deal? 

You could get at max 70k from that deal (minus closing costs).
