An attorney can cost you a lot, and winning in small-claims is simple enough (in NC, at least).

My goal of refinancing was simply lowering our monthly spending to reallocate towards future investments.

Also a local eviction attorney claims the LL winning rate in evictions is near 100% even with the friendly tenant laws.  

And definitely not, getting even 1 property in 2025 it'll be a win.

It's simply factual:  you violated the lease by smoking, stop it, remove the resulting odor and that a repeat action could result in eviction and loss of security deposit.  

It is also the seller's fault for accepting it, they full well knew this was not right.If you were to file for eviction for non-payment of rent, you'd probably win.
