Each year I have a handful of new or prospective clients come to us that have done some real estate investing with their qualified accounts, and in literally every single case they were doing things wrong without being aware (or just pretending to us they didn't know) that they were not following the rules - prohibited transactions and/or not addressing UBIT reporting.

This is an area that is certainly tightening up lately - almost more so as a protection against fraud (borrowers that can't qualify for a owner-occ conventional loan so they pretend to buy an investment property to get a home), but also just risk in general.

I know I pissed off the 2 buyers agents that wanted 3 % for bringing a buyer when I told them lets pretend its July and since you work for the buyer any payment you get is between you and them .

He has already submitted an application through Zillow, and we have the contact number of his current home manager.Please let me know if it's still a good idea to ask the potential tenant for a recommendation letter from their current landlord, or if calling the manager would suffice.By the way, what should we do if the tenant has simply provided a friend’s number, and the friend pretends to be the landlord or property manager, or if he just make fake letter?
