This is less of an issue here that what you all are describing.  

Be sure to research rental demand, zoning laws, and financing options before deciding.

You need to check with your state laws on wholesaling with and without a license. 

We have fair landlord-tenant laws, similar to Texas, but still the specific process is different.

Also, if it's Lennar, be prepared for problems, insulation issues and therefore paper thin walls.

If you are a legal property manager in your state the owner should have the unfettered ability to allow you to act as his/her agent to enforce the lease, whatever provisions they may contain plus whatever your state laws allow.

My in-laws own the property free and clear and it is part of 3 contiguous lots that they own (they live on 1 lot and there is another lot separating their lot from the lot we intend to purchase). 

I've got about $525K in equity in the property, but lenders have told me that I cannot get a HELOC to access that equity for additional purchases because the duplex was financed as an investment - they have said TX law dictates that HELOC can only be used on primary residences.
