We quickly received excuses, let downs, and broken promises; the kitchen floor would be replaced (needed!)

There's a crack in the foundation that has a small leak that doesn't appear structural and there are a few broken windows and no appliances as well.My agent has made the issues with the house obvious as a part of our offer paperwork but with a short sale I'm sure the bank doesn't consider all the problems with the house like a regular homeowner sale would.

@Ned Carey If I hire a lawyer to represent me at the court to defense me from the accusation, property damage, lease broken, .... and that I won the case, would the court order her to pay for all my legal fee?

It's really no different than refinishing existing flooring or repainting, replacing a broken window, or buying a new washing machine when the existing one dies.Now if you were to do something like upgrade to hardwood floors from carpet, that might be a different story. 

Peeling paint, ripped screens, bad roof, broken windows, damaged siding, wood rot, chimney falling down, etc. are all things (and more) that they will cite you on.Personally, actually living in Milwaukee, I prefer rental properties to be held to a standard of decency because I don't want rentals dragging down the neighborhood. 

Tile can be nice, as one cracked or broken tile is easy to replace while engineered wood/laminate can be a pain to get one "plank" out for replacement.

After multiple phone calls, emails and broken promises of returned calls I finally get an email notice, with a tracking number, that the release of mortgage has been sent for recording.The after days of waiting and checking, the release is never recorded.
