My advice strictly from the 1031 perspective would be to sell and 1031 as a group in the same manner that title was held in the old property.

Cap Rate is not subject financing so I'd compare it to CoC (cash on cash return) to see if this property would be better for a financed buyer vs a cash buyer or to see if this property should be held short term vs long term, etc.

Unless I had a VERY detailed confirmation from their lender that they didn't get financing for no fault of their own I will not be releasing any funds held in escrow.Whichever party attorney or title company was holding EMD cannot release without the seller agreeing to return of any portion unless the agreement dictated otherwise.That's the whole premise behind escrow.
