A dismissal without prejudice is a dismissal of a legal case that permits the plaintiff to bring the claim again, unlike a dismissal with prejudice, in which the matter is considered final.

If the fact pattern was different and after you went under contract you created value through a variance, permitting or other means then you have a different story to tell and some lenders will treat the imputed equity as your cash consideration.

You could even look at making the 2nd unit into a STR, before permits come in, since STRs are legal here in Vista.We're in Vista close to downtown and love the area (besides the noise from the train).

That fix apparently is now concealed and may be almost impossible to assess unless there is some documentation of what was done, and if a permit was pulled, and did it pass the building dept's inspections.
