Someone who was really enterprising could probably get a few bucks out of the bank beyond their deposit as a penalty. - If it was a sale based on a tax lien, in which the government was forcing the sale, and they allowed a sale to go through, then they are responsible.

My best guess is because it is not a "common enterprise" as described in the Supreme Court "Howie" Case.You may also have state laws to contend with.
